These Terms of Use ("Terms") govern your access to and use of the MotionTek Drive Systems website located at www.motiontek.ca (the "Website"), operated by Global Motion Technology Inc. ("Company", "we", "us", or "our"). These Terms apply to all visitors, users, customers, and any other persons who access or use the Website.

"OEM Builder"An original equipment manufacturer or machine builder who purchases Products for the purpose of integration into machines or systems built for their own use or for sale to third parties.
"Applicable Law"The laws of the Province of Ontario and the applicable federal laws of Canada, including but not limited to the Consumer Protection Act, 2002, the Electronic Commerce Act, 2000, and PIPEDA.

Eligibility & Access

This Website is intended for use by persons who are at least 18 years of age. By using this Website, you represent that you meet this age requirement. The Company reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion if it reasonably suspects a violation of these Terms or applicable law.

Users accessing this Website from outside of Canada do so at their own risk and are solely responsible for compliance with all local laws and regulations applicable in their jurisdiction. The Company makes no representation that the Website, its Content, or its Products are appropriate, legal, or available in all jurisdictions outside Ontario, Canada.

Safety Statement & Product Use Obligations

⚠ Critical Safety Warning

The assembly, installation, and operation of CNC machine components — including but not limited to power supplies, stepper motors, servo motors, motor drivers, spindles, inverters (VFDs), and related electrical components — involves exposure to potentially lethal voltages including AC and DC electricity. Improper installation or use can result in severe injury, death, property damage, or fire. Such work must only be undertaken by qualified individuals with appropriate knowledge, training, certifications, and experience in electrical engineering and electromechanics.

The Company is not liable or responsible for any accidents, personal injuries, fatalities, equipment damage, property damage, financial loss, or lost production time resulting from the improper, unsafe, or unauthorized use of any Products sold through this Website or any other Company sales channel.

OEM Builder Responsibilities

The Company primarily supplies components to OEM machine builders for integration into CNC machines, automation systems, and related equipment. It is the sole responsibility of the OEM builder to:

Limitation of Liability

To the maximum extent permitted by Applicable Law, Global Motion Technology Inc. shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

Governing Law & Jurisdiction

These Terms of Use, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.

You irrevocably agree that the courts of the Province of Ontario, Canada shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or your use of this Website. If you are a consumer resident in Ontario, you also have the right to bring a complaint before the Consumer Protection Ontario program or seek resolution through the dispute resolution mechanisms available under the Consumer Protection Act, 2002.
